What is a Discretionary Will Trust?
A common concern for parents in particular is that the children may not be mature enough to deal with a potential influx of money should they pass away whilst the children are still relatively young. This is led to the rise of discretionary trusts been implemented in many will which appoint a trusted person known as a trustee to Look after the money received in the estate for the children until the time that they are mature enough to deal with it reasonably.
This does not mean that the trustee cannot release any money early to the children but the children must first make a request for this which is then up to the trustee decide whether it is reasonable.
